This section outlines the obligations and liabilities concerning customs clearance, duties, taxes, and compliance with import/export laws.
4.1 Customs Clearance
- The Customer is the “Importer/Exporter of Record” and shall be solely responsible for the truth, accuracy, and completeness of all customs declarations, commercial invoices, packing lists, and any other documents required by customs authorities.

- b) Failure to obtain necessary import/export licenses or permits.
- c) Violation of any laws or regulations of the country of origin, transit, or destination.
4.3 Prohibited and Restricted Goods
- The Customer warrants that the goods are not prohibited by any applicable law (e.g., narcotics, counterfeit goods, weapons, protected species).
- The Company reserves the right to inspect or open any shipment (at its discretion) to verify compliance, but is under no obligation to do so. The Company assumes no liability for failing to identify prohibited goods.
4.4 Detention and Examination
- If shipments are detained, inspected, or held by Customs or other governmental authorities, the Company shall use reasonable efforts to notify the Customer.

4.5 Indemnification
- The Customer agrees to indemnify and hold harmless the Company, its directors, employees, and agents from and against any and all claims, liabilities, costs (including legal fees), and expenses arising out of:

- c) Any action taken by customs or regulatory authorities in connection with the shipment.
5. LIABILITY FOR LOSS OR DAMAGE
